lien on home

Question: my previous family law lawyer put a lien on my home after winning a judgement against me for unpaid fees. would this be included in a consumer proposal?

Answer: Probably not.  Secured creditors, such as mortgages and liens, are not automatically discharged in a consumer proposal.  The only possible exception would be where the lien had no value, such as where the value of the home is less than the value of the first mortgage.

You should consult with another lawyer, or a bankruptcy trustee, for further information.
